La inhabilitación definitiva de la licencia de conducir y la vulneración al derecho de trabajo de los transportistas

Abstract

En la actualidad, en el código Penal Peruano se encuentra tipificado un delito de inhabilitación de la licencia de conducir por tiempo indefinido a causa de corromper a un agente policial para evitar una infracción, por lo que, de acuerdo a sentencias del poder judicial y artículos científicos, nos ayudan a comprobar si tal pena accesoria resulta desmedida y atenta contra el derecho de trabajo de las personas dedicadas al rubro del transporte público o privado, por ende, el presente proyecto de investigación tiene por objeto determinar si la inhabilitación definitiva de la licencia de conducir vulnera el derecho de trabajo de los transportistas. Asimismo, para entender el presente se, ha investigado de diversas fuentes la definición de la inhabilitación definitiva de licencia de conducir y el derecho de trabajo en sentido general, para así llegar a un grupo de personas específicas como los transportistas, también se ha analizado si la pena que implica la inhabilitación definitiva de la licencia de conducir vulnera el derecho de trabajo de los transportistas, con el fin de proponer penas alternativas referentes a la inhabilitación de carácter temporal y no definitivo, considerando el derecho de trabajo de dicho grupo mencionado.Currently, the Peruvian Penal Code establishes the crime of disqualifying a driver's license for an indefinite period of time due to corrupting a police officer to avoid an infraction, therefore, according to rulings from the judiciary and articles scientists, help us to verify whether such ancillary penalty is excessive and violates the right to work of people dedicated to the field of public or private transportation, therefore, the purpose of this research project is to determine if the definitive disqualification of the license driving violates the right to work of transporters. Likewise, to understand the present, the definition of the definitive disqualification of a driver's license and the right to work in a general sense has been investigated from various sources, in order to reach a group of specific people such as transporters, it has also been analyzed if The penalty that implies the definitive disqualification of the driver's license violates the right to work of the transporters, in order to propose alternative penalties referring to the disqualification of a temporary and non-definitive nature, considering the right to work of said group mentioned.
