Tipificación de las conductas que mediante el uso de inteligencia artificial vulneran el honor personal

Abstract

El presente trabajo de investigación examina el problema emergente del uso de inteligencia artificial (IA) para crear y editar imágenes y videos de contenido sexual, en los que se atribuye falsamente la identidad de una persona, práctica conocida como "deepfake". El objetivo central del trabajo es proponer una tipificación adecuada para estos delitos, para lo cual primero se plantearon 2 objetivos específicos: analizar la legislación peruana y comparada respecto al delito contra el honor y argumentar la propuesta de tipificación en el código penal de las conductas que mediante el uso de la inteligencia artificial atentan contra el honor personal; en los que se encontró que en la realidad nacional e internacional ocurren frecuentemente estas conductas, y respecto a la legislación peruana, ésta carece de tipificación de estas conductas, en cuanto a la legislación de países como Argentina, México y España, se encuentran reguladas las conductas, sin embargo no se logra sancionarlas con efectividad. En consecuencia, la propuesta planteada ante el problema es la tipificación en el Código Penal del delito de difamación mediante el uso de la inteligencia artificial, en un artículo independiente dentro de los delitos contra el honor. Para ello, se realizó un análisis bajo la metodología del paradigma analítico, previa evaluación de la realidad en el Perú e internacional, respecto a la propuesta de tipificación de las nuevas conductas, en base a esta realidad es que se da la revisión de casos recientemente ocurridos.This research paper examines the emerging problem of the use of artificial intelligence (AI) to create and edit images and videos of sexual content, in which the identity of a person is falsely attributed, a practice known as “deepfake”. The main objective of the paper is to propose an appropriate criminalization of these crimes, for which 2 specific objectives were first proposed: to analyze the Peruvian and comparative legislation regarding the crime against honor and to argue the proposal of typification in the penal code of the conducts that through the use of artificial intelligence attempt against personal honor; in which it was found that in the national and international reality these conducts occur frequently, and regarding the Peruvian legislation, it lacks typification of these conducts, as for the legislation of countries such as Argentina, Mexico and Spain, the conducts are regulated, however, they are not effectively punished. Consequently, the proposal put forward in response to the problem is the inclusion in the Penal Code of the crime of defamation through the use of artificial intelligence, in an independent article within the crimes against honor. For this purpose, an analysis was carried out under the analytical paradigm methodology, prior evaluation of the reality in Peru and internationally, with respect to the proposed criminalization of the new conducts, based on this reality is that the review of recently occurred cases is given.
